Contract to use Vertu Lease Cars Website

4. Please read these terms and conditions carefully - if you use our site you are deemed to have accepted these terms and conditions and thereby have entered into a legally binding contract. The terms and conditions stated need to be read in conjunction with the order you accept from us. Please leave this site if you do not wish to accept these terms and conditions.
   We reserve the right to make changes to these terms and conditions from time to time which will take effect from the date when the changes are posted on this website. Your continued use of this website will constitute your acceptance of any changes to these terms and conditions. Please remember that throughout these terms and conditions when we mention "we", "us" or "our", we mean Vertu Lease Cars which is a trading style of U.K. Carline Limited. When we refer to "you" we mean the user of our website.

Website Information

1. For the purposes of these terms and conditions the expression "Website Information" means the images, applets, scripts, text and graphics operating in or which form part of this website.
2. All intellectual property rights in the Website Information, in the selection and arrangement of the Website Information, in the design of this website and in all software compilations, underlying source code, software and all other material operating in or forming part of this website are owned by Vertu Lease Cars, or its content and technology providers except in so far as individually stated or acknowledged by us on particular material or items.
3. Without affecting our own or any third-party intellectual property rights, you are not permitted to copy, alter, or reproduce any of the content of this site without our prior written consent.
4. You may view Website Information in a web browser for private use only. Copying Website Information into a computer cache or storage device for private on or off-line use is also permitted. You may not make a copy of the Website Information or any part of it for any other purpose without out prior written consent, which may be granted at our sole discretion.
5. Nothing in these terms and conditions or on this website constitutes a licence to use or copy the Website Information.
6. This website, like any other website is susceptible to potential cyber squatting and online vandalism. Vertu Lease Cars do not accept any responsibility for, or any liability of, any information that appears on this website because of cyber-squatting or online vandalism.

Vehicle Information

1. The vehicle specifications displayed on the website are supplied by the vehicle manufacturers to CAP, IDS, Imagin, and EV Database and formatted for our use. Whilst every effort is made to verify and ensure the accuracy of the data, the information should only be used as a guide and no decision should be made to purchase, hire, or lease a specific vehicle without verification of the latest data from either the manufacturer or franchised dealer. For the avoidance of any doubt Vertu Lease Cars will not be liable for any loss or damage arising, in contact, tort or otherwise, directly, or indirectly from the use of or reliance upon any information contained on the Website, nor products or services provided by third parties (whether individuals or corporations) featured on the site.
2. Once you enter into an agreement, you will be responsible for the running, upkeep, service, and maintenance of that vehicle in accordance with the manufacturers recommended service and maintenance schedule by an approved service and maintenance agent. If you have a fully maintained contract, you are also responsible for making sure the service and maintenance are carried out in accordance to the maintenance contract.
3. All images on the website are for illustration purposes only.
4. All vehicle colours on the website are for illustration purposes only.
5. We reserve the right to make any changes to the Website Information without notice and without incurring any liability to you.
6. For pre-registered vehicles sold with the balance of the manufacturer’s warranty, an MOT will be required (at customers cost) 3 years from the published taxation point, in line with UK law. If a vehicle has been pre-registered prior to delivery to you, you will receive the balance of the manufacturers warranty and any roadside assistance cover that was also supplied by the manufacturer. If the manufacturers warranty expires during your lease contract period, you will be liable and responsible for any servicing, repairs, or breakdown costs unless you are also covered by a funder maintenance contract. If you do have a funder maintenance package, then any repairs may be covered as per the terms and conditions of your contract. You can find out more information about pre-registered vehicles here.
7. Vehicles that have been pre-registered prior to delivery to you may have been registered several months prior to the delivery date to you. Please check if your vehicle has been pre-registered as this will have an impact on your service schedule and MOT date.
8. All Business Contract Hire and Personal Contract Hire agreements include road fund licence (VED) for the duration of your contract. Finance Lease agreements include the first 12 months as a minimum, please check the terms and conditions of your lease agreement carefully. If the cost of the road fund licence or VED goes up during the term of your agreement, or any extended term, you will be liable to pay the amount of any increase to the finance company.
9. Luxury Vehicle Tax – There is also an additional VED tax called “Luxury Vehicle Tax” which is payable on cars with a retail price of £40,000 or more. This is an additional tax of £390.00 which is payable on top of the standard road fund licence for the first 5 years from date of registration. IMPORTANT – If you have ordered a vehicle that was under the retail value of £40,000, but on delivery the retail price has increased to either, equal to, or in excess of this £40,000 level, you will be liable for the additional charge of £390.00 per year, this will be invoiced separately to you by the finance company every year for the full term of your agreement.

Prices

1. Prices quoted for personal leasing include VAT.
2. Prices quoted for business leasing exclude VAT.
3. Should the VAT rate change between the placing of the order and the end of your contract, monthly rentals and Road Fund License will be adjusted accordingly.
4. Should the Road Fund License rate change during your contract your finance company may charge you accordingly.
5. Unless stated to the contrary advertised prices include
   i. Delivery by the dealer to your chosen UK mainland destination, however Vertu Lease Cars reserves the right to pass on any additional costs associated with delivery on certain vehicle offers. You will be advised of any additional charges prior to the order being processed by us. If they are unacceptable, you will be entitled to choose an alternative vehicle or cancel your order with a full refund,
   ii. Number plates,
   iii. Road Fund Licence for the term (if applicable), and
   iv. Vehicle Registration Charge.
6. Vertu Lease Cars reserves the right to change the price of the vehicle, either before or after an order is placed. If the price of a vehicle is changed after an order is placed Vertu Lease Cars shall notify you of the change and you have the right to withdraw your order if the change is not acceptable.
7. Prices quoted may vary depending up on vehicle colour. This is a result of different residual values set by the finance company or may depend upon stock availability.
8. Prices on the web site are for information purposes only and do not constitute an offer by Vertu Lease Cars which is capable of acceptance by you.
9. Prior to processing your order, a processing fee will be required. The amount required will be stated on your order form prior to acceptance by you.
10. In certain circumstances a holding deposit may also be required. A holding deposit of up to £1000 may be required prior to the order being placed. This applies to factory ordered vehicles with additional specification requested. If a holding deposit is required, this will be stated on your order form prior to acceptance by you.
11. The subsequent cancellation of any vehicle order will result in a cancellation fee. The amount required is stated on your Information Notice. You will receive the Information Notice with your confirmed quotation.

Orders

1. An order of a vehicle from the Vertu Lease Cars' website is an expression of interest by you to obtain the vehicle ordered at a price similar to that advertised.
2. An order does not create a contract between you and Vertu Lease Cars, ‘UK Carline’ ‘Vertu Lease Cars’ to purchase, hire or lease a vehicle. In order for a contract to be created between you and Vertu Lease Cars to purchase, hire or lease a vehicle, Vertu Lease Cars must locate a suitable vehicle that matches the specification you agree to at a price agreed between you and Vertu Lease Cars. You then must enter into a finance agreement with a finance company. For the avoidance of any doubt, the contract to purchase, hire or lease a vehicle is between you and the finance company, and their contract becomes binding when the agreement is signed by you and counter signed by the finance company. Some agreements are pre signed by the finance company and become binding once you sign the agreement and there are no enforced changes to the pricing imposed by the funder, supplier, or vehicle manufacturer between signing the contract and delivery of the vehicle. By signing the order electronically or wet sign you are agreeing for Vertu Lease Cars to source and order the vehicle(s) for you.
3. If the vehicle you have ordered is not available, Vertu Lease Cars will contact you by email or telephone to provide possible alternatives. If the alternative is not acceptable by you, Vertu Lease Cars will cancel your order and refund any monies paid. If the vehicle is available Vertu Lease Cars will confirm an estimated delivery time. Please note that any dates provided are intended as a guide only and should this date change, we will notify you once we have the information available.
4. We may introduce you to our carefully selected panel of finance providers who may then pay us for the introduction. We will not refer you outside of this panel.
5. Following a completed proposal application, we will carry out a credit check on you the individual or company and company directors or partners as part of your application process. If you are applying on behalf of a limited company, you are confirming you have authority to authorise a credit search in the name of the Company and each Director. The finance company reserves the right to decline any application.
6. If after you have been accepted for credit, a new credit proposal is needed because your credit approval has expired, there was an error or omission in your original application, the finance company asked for a new credit application or you wish to apply for finance with a new finance provider, a further credit search may be made on your behalf and this may show on your credit report.
7. Providing we have received accurate information on your credit application form, most finance providers will respond to a credit application within a few hours to a couple of days, but this also could take up to 14 days during busy periods. Vertu Lease Cars will do our best to give you a speedy response to your credit application, but this is subject to the finance company. Vertu Lease Cars can not secure a vehicle or guarantee the price of a vehicle or the monthly rentals of a lease agreement until we have received an approved finance acceptance and you have entered into a binding contract with the finance provider.
8. All prices advertised on the Vertu Lease Cars website are subject to availability and may change at any time. Prices or/and availability of vehicles may change at any point during the time of initial enquiry to the time of your finance acceptance and or vehicle order.
9. Estimated delivery dates are given at the time of enquiry and are subject to change, Vertu Lease Cars will always do our upmost to keep to this estimated delivery date, but we have no control of changes to this delivery date caused by manufacturer build delays or supplying dealership delays.
10. Vertu Lease Cars may charge a cancellation fee for services already provided if a vehicle is cancelled. We may also retain any holding deposit or processing fee already paid. Please see our cancellation policy here.

Delivery/Registration

1. Upon receipt of a correctly completed and signed finance agreement; payment of the processing fee, and if applicable payment of any balance of monies, Vertu Lease Cars will arrange delivery of the vehicle to either your home address or business address depending on the finance companies’ terms & conditions.
2. Please note that the monthly rental/lease price includes the cost of driving the vehicle to your specified address, provided your address is situated on the UK mainland. Certain delivery locations in Scotland, the Scottish Highlands, Islands or the far South may incur an additional delivery charge; and we reserve the right to recover this charge from you. However, we will advise you if there is an additional delivery charge prior to you completing the finance documentation. If the additional charges are unacceptable to you, you may be able to choose a different or alternative vehicle or cancel your order.
3. We may be able to deliver to certain addresses in Northern Ireland (NI) but this is subject to approval by the finance provider. Some finance providers may insist that vehicles are supplied locally by dealerships based in NI, this means that not all offers available on the Vertu Lease Cars website will be available in NI. If you are looking to lease a vehicle and you are based in NI, please speak to us prior to placing an order or completing a finance application.
4. Deliveries to the Isle of Wight (IOW) will incur additional delivery costs and further identification documentation.
5. Most finance companies will allow up to 100 miles to arrange delivery of your vehicle. This will not impact your pre agreed mileage allowance on your lease contract. Additional delivery mileage over 100 miles may be deducted from your contracted lease agreement subject to the finance company being used for your contract. Transported delivery is available at additional cost.
6. Transported Delivery (the vehicle is delivered on a trailer/transporter) this can be arranged but an additional charge will be made, please ask your Sales Advisor for further details.
7. Information on "lead times" are estimates only and do not constitute an obligation to supply the vehicle in the time specified. Delivery dates are subject to change by the manufacturer, and Vertu Lease Cars has no control or influence over manufacturer lead times and will not accept any responsibility for any losses or inconvenience caused because of a delay by the manufacturer.
8. Please note that the statutory cooling off period observed by finance companies applies to all vehicles, and vehicles will not be delivered until the ’cooling off’ period has expired.
9. Local registration of vehicles is not possible.
10. Proof of insurance is required before delivery can take place. Please note that the hirer obtaining finance must be the main policy holder or a named driver on the insurance certificate and the insurance must be a fully comprehensive policy.

Excess Mileage

The standard excess mileage charge as set out on your lease agreement is valid for up to 100% of the annual mileage allowance. Any additional mileage in excess of 100% of the allowance may be subject to a higher rate. This will be recorded on your finance agreement/lease contract if applicable. Please make sure you read your finance agreement/lease contract in full. If you do not understand any element of your agreement or contract, please contact us for further clarification.

Car Accessories

1. All non-dealer fit accessories are potentially available; however, Vertu Lease Cars will be required to investigate the availability of the required options prior to providing an estimated delivery date.
2. Vertu Lease Cars reserve the right to refuse installation of an accessory or to offer an alternative if in the sole opinion of Vertu Lease Cars the product is not suitable for installation on the specified vehicle.
3. Vertu Lease Cars reserves the right to remove accessories from the order and offer a full refund of any specified accessories which are removed, if it is discovered that the goods are unavailable and/or in the sole opinion of Vertu Lease Cars are unsuitable for fitting to the vehicle. Please note that the removal/non-fitment of non-dealer fitted accessories does not entitle you to cancel any finance or lease agreement you have already entered into.

Special Offers / Cashback

1. From time-to-time Vertu Lease Cars may offer Cashback deals wherein cashback is paid to the customer as part of the lease deal. Cashback is paid out on the delivery of the vehicle.
2. Special Offer banners on our website refer to specific vehicles and are subject to availability and change at any time.
3. In Stock banners on our website refer to vehicles that are built and in stock at the dealership, import centre or holding compound of the manufacturer. The delivery of In Stock vehicles may vary depending on where the vehicle is stored.
4. Delivery Month banners display the estimated month of delivery available at the time of advertising and are subject to change.

Statutory Rights

1. Nothing in these conditions shall affect your statutory rights.
2. Vertu Lease Cars is committed to customer service. Should you have any complaint about our service, we will endeavour to resolve them in a fair and effective manner.
3. For a copy of our customer complaints procedure or if you have a complaint about our service, you should email complaints@vertuleasecars.co.uk. We are committed to acknowledging your complaint within 3 working days of receipt and undertaking all reasonable efforts to resolving it promptly under the circumstances. We will provide you with a timescale for resolving the dispute and keep you regularly updated with its progress. We would seek to resolve any complaint or concern you may have in the first instance if we are unable to then you may be able to refer your complaint to the Financial Conduct Authority
